Preambule

These Terms and Conditions exclusively regulate the activity of distribution of products by means of sending a box in order to allow manufacturers to promote the identity of their products only to people who have a subscription contract (hereafter, "the Box Delivery Service").
For the purposes of this document, it is agreed that people who have entered into a subscription contract will be referred to as, "Clients."
These services are available on the website, "www.mylittlebox.co.uk" (hereafter "the Site"). These Terms and Conditions are routinely made available on the current Site to the Clients at the time of purchase of a subscription.

Governed by Section 2 of the Supply of Goods and Services Act 1982, these Terms and Conditions shall determine the rights and obligations of MY LITTLE PARIS SAS and of the Clients (collectively, "the Parties", individually, "The Party") to the different contracts offered on the Site.
By the simple confirmation of his order on the Site, the Client declares to have read, understood, and accepted without reservation the terms for the said order, as well as all of these Terms and Conditions.
The Terms and Conditions are only valid in English.
These Terms and Conditions shall apply on the date of the subscription according to their wording on the Site. They may, however, be subject to change.

Article 1 - Company overview

The www.mylittlebox.co.uk Site is published by MY LITTLE PARIS SAS with a capital of 79 967€ (£64,047), whose registered office is located at 13 boulevard de Rochechouart in Paris (75009), listed with the Paris Trade and Companies Register under the number 505 075 846. The intra-community VAT number is FR56505075846.

Article 2 - Legal status

The Clients declare to be at least 18 years old to be legally eligible to fenter into a contract.

Article 3 - Geographic area

The Box shipping service is only available in the UK. Subscriptions that do not meet this geographic condition will not be taken into consideration.

Article 4 - Access to the service

The Site services are normally accessible to Clients seven days a week, 24 hours a day, throughout the year except in the case of interruption, voluntary or not, in particular due to maintenance needs or major events. The company MY LITTLE PARIS SAS cannot be held liable for damage of any nature resulting from unavailability of the Site.

Article 5 - Conditions of the box shipment service contract

The box shipment service consists of a shipment, each calendar month, of a "box" containing samples of cosmetics or similar and related products.
Subscription to the box shipping service contract offered by the company, MY LITTLE PARIS SAS, is carried out on the Site.
By subscribing to one of the box shipping service contract packages, the Client accepts these Terms and Conditions, and the Client acknowledges having read and understood them, and accepts them without reservation and with full knowledge of cause.
In the interest of good administration of the subscription by the Client to one of the box shipping service subscriptions, the Client shall complete a form containing personal information. The information provided to MY LITTLE PARIS SAS must be accurate. The Client must ensure their accuracy and their truthfulness when subscribing. In case of misinformation, MY LITTLE PARIS cannot be held liable.
The Company MY LITTLE PARIS SAS offers four types of subscription to the box shipping service: either a monthly subscription for yourself with one payment each month (5.1), a quarterly gift subscription with a one-time payment (5.2), a half-year gift subscription with a single payment (5.3), or an annual subscription for yourself or as a gift, with a one-time payment (5.4). Members will only be considered to posess full product ownership once the Site has received, in full, all payments for sums repsective to the products and delivery charges.

5.1. Monthly subscription, with payment each month.

The monthly subscription provides the member with a monthly box shipping service until a Party decides to terminate this contract. By accepting this offer, the Client accepts an automatic monthly deduction of an amount specified in the original order. Thus, for as long as the subscription lasts, the Client will, at the beginning of each month, be automatically charged the set amount, and the Client will later receive the box between the 10th and 20th of the month.
The Subscriber may terminate his (their) monthly subscription at any time, as provided in the article related to unsubscription in these Terms and Conditions.

5.2. Quarterly gift subscription, with a single payment.

The quarterly subscription allows someone to subscribe themselves or a third party for a period of three months, therefore three (3) Boxes. Payment for this subscription will be made in a single payment, upon subscription.

5.3. Half-year gift subscription, with a single payment.

The half-year subscription allows someone to subscribe themselves or a third party for a period of six months, therefore six (6) Boxes. Payment for this subscription will be made in a single payment, upon subscription.

5.4. Annual subscription, for yourself or a gift, with a single payment.

The annual subscription allows someone to subscribe themselves or a third party for a period of one year, therefore twelve (12) Boxes. Payment for this subscription will be made in a single payment, upon subscription.

5.5. Subscription with a fixed term period.

Subscribing to a subscription with a fixed term duration allows the subscriber or a third party to sign up for an indefinite period with a fixed term commitment period. The customer will, at the beginning of each month, be automatically charged for the Box of the current month. A customer can avail of a promotional offer on the condition that the subscription is on fixed term subscription period, the customer will not be able to end their subscription before the end of this fixed term period. At the end of this fixed term period, the subscription will automatically be renewed to a monthly recurring subscription. At this point, the subscriber may terminate his (their) subscription at any time.

Article 6 - Subscription to the newsletter

By accepting these Terms and Conditions when subscribing to one of the subscription packages, or placing an order on the Site, the Client authorises MY LITTLE PARIS SAS to email them at the address that will be provided upon their subscription or order.
The newsletter can be unsubscribed to at any time via the "My Account" page.

Article 7 - Unsubscription

Only Clients receiving a monthly subscription can unsubscribe. The Client may at any time terminate their monthly fee on the "My Account" page.
If termination occurs after the automatic deduction is made at the beginning of each month, the order is deemed made for that month. The subscriber may request the cancellation of this order on the grounds of his (their) application for cancellation. The unsubscription will be taken into account for the next month.
In the case of unsubscription, a Client receiving a subscription at a lower price due to their age will lose this benefit and will have to pay the current price if they want to re-subscribe.
Unsubscribing may also result in a decision by MY LITTLE PARIS in the manner provided for in the article relating to deactivation of the Client's account.

Article 8 - Deactivation of the Client's account

In the case of non-compliance arising from the acceptance of these Terms and Conditions, non-payment of the price of an order, intentionally providing wrong information to create the account, or actions that could harm the interests of MY LITTLE PARIS SAS, the Company reserves the right to suspend access to the services offered on the Site or, depending on the seriousness of the acts, to terminate the subscription and the account of the Member without any compensation.
The company also reserves the right to refuse service to a Client who has been excluded or penalised for such actions.

Article 9 - Fees and payment


9.1 General payment terms for all Site services

Payment for services will be made via credit card (Visa, Mastercard, American Express). Payments will be secured by a method of data encryption to prevent interception of information by third parties.
MY LITTLE PARIS SAS cannot be held responsible for any fraudulent use of the payment method used.
Within three days after receiving the subscription request, a debit request to the bank account will be sent to the payment organisation. The subscription contract will be complete upon receipt of authorisation to debit the account by the payment organisation.
In accordance with current regulations, Member bank details will not be kept by MY LITTLE PARIS SAS.

9.2 Fees and payment for the monthly box shipping service

Service fees for the monthly box shipping are those presented on the Site, all taxes included. The fees can be changed. Where applicable, the changes apply only to future orders, and orders already paid for will not be affected by the rate changes.

Article 10 - Evidence

The Client recognises the validity and the probative value of electronic exchanges and records kept by MY LITTLE PARIS SAS and admits that these have the same probative force as those written and signed by hand, pursuant to Section 7 of the Electronic Communications Act 2000, adapting the evidence law to information technology and related to electronic signatures.

Article 11 : Delivery

Service area
The box shipping service only covers the geographic area specified in the article, "Geographic area", which is to say, the UK.

Methods of delivery
The Box will be delivered to the Clients before the end of the month to the address provided in the information form, "My Account," completed by the Client during registration. In case of change of address, it is up to the Client to provide notification at least fifteen days prior to the beginning of the month in question by modifying their address on the information form, "My Account."
If the package is returned to MY LITTLE PARIS SAS, a second delivery will be made. If the package is returned to the sender again, there will be no new shipment.

Means of delivery
Only delivery by Royal Air Mail is available.
Deliveries are made Monday through Saturday except public holidays. The package is carried by Royal Air Mail and delivered to the shipping address provided by the Client.
If you are not present for the delivery and if the dimensions of your package allow it, the postman will leave your package in your letterbox. If not, you will find a calling card asking you to collect your package at your post office within 15 days.

Delivery time
Boxes are shipped the first week of the month and the delivery time is as follows: from 5 to 10 working days.
The delivery times indicated above are those generally observed. The delivery time may be extended by two days during sales or other promotions.
In addition, MY LITTLE PARIS SAS informs its Clients that these delivery times do not include Sundays or public holidays.
At any time, you can check the status of your order in the section "My Account”, under "My Subscriptions."

Article 12 - Reimbursement

Any reservations about the box and its contents must be reported within three days of receipt of the box. In case of defect in the box and/or the established order, the Client may have a new box and/or order within the limits of available stock. If the box is out of stock, the Client will get the next month's box free. If the products for the order are out of the stock, MY LITTLE PARIS SAS will reimburse the amount of the order.
Missing or defective products contained within the box will result in exchange for the same product, depending upon stock availablility, or another product.
Failure to receive a box cannot result in other compensation. In any case, the liability of MY LITTLE PARIS SAS is limited to the monthly value of the subscription and the order.
To obtain reimbursement under these conditions, the Client must give notice of their choice to be reimbursed within a period of thirty (30) days. Reimbursements will usually be made through the same means by which the payment was originally made.

Article 13 - Major events

MY LITTLE PARIS SAS may not be considered as accepting liability for total or partial breach of contract that would arise due to Force Majeure Event.
A Force Majeure Event relates to any event or circumstance beyond our reasonable control.
During the period of a Force Majeure event, we are not liable for any failure to fulfil our contractual obligations. We will, however, do our best to perform to the best of our ability throughout this period despite the Force Majeure Event.

Article 14 - Product conformity

The information present on the Website related to the products are provided by the manufacturers and distributors. MY LITTLE PARIS SAS cannot, therefore, be held liable under any circumstances for any consequences that may arise from the knowledge or use of such information.

Article 15 - Intellectual property

All elements of the Site, whether visual, audio, text, layouts, illustrations, photographs, documents, or other elements, including the underlying technology, are protected by copyright, trademarks, and patents. Total or partial reproduction of the elements available on the Site is strictly prohibited.

Article 16 - Withdrawal option

In accordance with the current applicable consumption code and as part of remote selling, the Client has the right to withdraw within fourteen (14) days after acceptance of an offer of subscription. Notice of withdrawal must be made by post or email (via the "Contact" page on www.mylittlebox.fr) to MY LITTLE PARIS SAS at the address mentioned in Article 1 of these Terms and Conditions.
The fourteen (14) day delay is also applicable in case of withdrawal after receiving the box. This period starts from the date of receipt of the monthly box. The merchandise must be returned in their original packaging and condition. Any incomplete or damaged products, or damaged and/or missing packaging may not be returned, exchanged, or refunded. For the subscription of a complete box per month, the return of the complete box is necessary.
If applicable, MY LITTLE PARIS SAS will reimburse the Client who has notified within the time period that they wish to exercise their right of withdrawal within thirty (30) days from receipt of the notification of withdrawal. The Client's account will be credited for the amount charged.

Article 17 - Information and Freedom

The information requested from the Client in the form at the time of registration is necessary to process the order and may be communicated to contractual distributor partners of the Site involved in the framework of the execution of this order.
In accordance with applicable law, the Client has the right of opposition, the right of access, and the right of rectification of the data concerning them. The Client may require that any of their information be modified, supplemented, completed, clarified, or deleted if it is erroneous, incomplete, or outdated, or when collection or use of the communication is prohibited. To exercise this right, the Subscriber must simply write to us on our "CONTACT US" page.
We reserve the right to use the statistics provided by the information forms that the Subscribers will complete in order to optimise our service and those of our partners.

Article 18 - Liability

MY LITTLE PARIS SAS as a third party cannot be found liable for the contents of partner sites of MyLittleBox, and it also cannot be found liable in case of any conflict between the Client and a partner site or brand.
Information allowing the Client to be identified, such as the username and password, are personal and confidential. This information cannot be modified by the Client or www.mylittlebox.co.uk, even if you forget your password.
The Client is solely responsible for the use of their identifying information, and it must be kept secret. Any disclosure on their part will in no way be blamed on www.mylittlebox.co.uk.
Any order placed using the Client's username and password is considered to be placed by them. www.mylittlebox.co.uk will in no way be held responsible for damages caused by the divulgance of this personal and confidential information by the Subscriber and subsequent use of this data by a third party.
MY LITTLE PARIS SAS may not in any way be held liable for any damages of any kind, in particular due to the use of subscription services, whether to reputation, to image, or loss of data that might arise from the use of services offered by www.mylittlebox.co.uk.

Article 19 - Safeguard clause

If one or more provisions of these Terms and Conditions are declared invalid under any law or regulation or a final court decision, the other provisions will retain power and scope.

Article 20 - Transfer of rights and obligations

In case of total or partial sale of MY LITTLE PARIS SAS, the contracts between the Client and MY LITTLE PARIS SAS and/or successors and beneficiaries remain binding between the parties. The contracts entered into by MY LITTLE PARIS may not be transferred by the Subscriber and/or the Client without first giving written notice to MY LITTLE PARIS SAS.
The contracts, rights, and obligations of MY LITTLE PARIS SAS will in any event be assigned or transferred without prior approval by the Client.

Article 21 - Advertising on the Site

MY LITTLE PARIS SAS may freely insert advertising on its Site, and has complete freedom of choice regarding the disposition of these ads, advertisers, and viewing of these ads.

Article 22 - Modifications to Terms and Conditions

MY LITTLE PARIS SAS reserves the right to modify these Terms and Conditions at any time.
If the new Terms and Conditions are not suitable for a Client, they should terminate their subscription by registered mail before the new provisions go into effect, in the manner prescribed in the Article, "Withdrawal option" in these Terms and Conditions.
Refusal of the new Terms and Conditions must be explicit. Without explicit expression of wishes before the new provisions go into effect, the Client will be considered to have accepted the changes.

Article 23 - Applicable law

These Terms and Conditions are subject to applicable British law irrespective of the Client's country of residence and the place of conclusion of the contract. The application of the Vienna Convention on the International Sale of Goods is expressly excluded.
The Subscriber acknowledges that the communications and computerised records of the Site will be considered by the parties as proof of exchanges, orders, payments, and transactions between the parties unless proven otherwise.
